In 2008, Public Law 110-181, The National Defense Authorization Act for FY 2008, was enacted. Due to Congressional concern about a revolving door between the Dept. of Defense (DOD) and private industry and potential conflicts of interest when top military leaders seek jobs with companies that do work for the government, Section 847 of the law, Requirements for Senior Department of Defense Officials Seeking Employment with Defense Contractors, required all officials covered by the law to request an ethics opinion from a DOD ethics counselor before starting employment with a DOD contractor. Defense contractors are required to ensure that covered officials have received the required opinions before employing them. DOD was also mandated to retain this information in a central database or repository for not less than 5 years. This report concludes that DOD has failed to maintain a complete database of generals and other high-ranking officials who may be joining defense contracting firms after they leave the military, and thus may not have fully complied with the intent of Section 847.
