Overview of Recent U.S. Supreme Court (SC) Jurisprudence in Patent Law
Brian T. Yeh (au)
Patent law jurisprudence is continually being developed through litigation over activities that allegedly infringe a patent holderäó»s rights. The losing party in these cases may appeal the district courtäó»s decision to the U.S. Court of Appeals for the Fed. Circuit. Parties dissatisfied with the Fed. Circuitäó»s rulings may petition the SC to review the appellate courtäó»s decision. The SC Justicesäó» newfound interest in patent cases perhaps stems from a recognition of the growing importance of intellectual property, as well as a desire to correct perceived errors in lower courtsäó» interpretation and application of patent law. This report provides a brief summary of the SCäó»s patent law jurisprudence in nine cases that have been decided since 2005. A print on demand report.
