Tobacco Recoupment: Hearing Before the Committee on Appropriations, U.S. Senate
Kay Bailey Hutchinson (ed). The Senate bill intends to clarify existing Fed. law to prevent what is believed to be an erroneous interpretation of that law by the Health Care Financing Admin. (HCFA). HCFA’s position has been that every dollar of every State settlement is directly attributable to Medicaid & that the Fed. Gov’t. is therefore entitled to 57% of those funds, which is the national average Fed. share of the Medicaid program. Supporters of the bill believe that it is wrong for the Fed. Gov’t. to try to seize any of these State funds. It will lead to years of protracted litigation that would tie up the money. To clarify this situation, this bill has been put onto the supplemental appropriations bill.
