(CFTC) under the Commodity Exchange Act (CEA), & privately negotiated swaps & OTC derivatives contracts. This report addresses the questions of appropriate regulatory structure for these contracts, markets, & market participants focusing on the extent to which the CFTC has reduced the legal risk surrounding the enforceability of OTC derivatives under the CEA & the appropriate regulations for exchange-traded futures & OTC derivatives contracts.
