Official Insignia of Native American Tribes: Study Pursuant to P.L. 105-330 Presented by the U.S. Patent & Trademark Office
Q. Todd Dickinson. Title III of Public Law 105-330 requires the U.S. Patent & Trademark Office (PTO) to study how the official insignia of Native American Tribes (NAT) may be better protected under trademark law. The report recommends that: (1) an accurate & comprehensive database containing the official insignia of all State & federally recognized NAT should be created; (2) the U.S. PTO should create, maintain & update this database; (3) relevant federal agencies should work cooperatively to educate & assist NAT in their efforts to protect their official insignia; & (4) Fed. agencies should work cooperatively to educate the public with respect to the rights surrounding official insignia of NAT.
