United States Foreign Intelligence Surveillance Court of Review
Bruce Marshall Selya (au)
This petition for review stems from directives issued to the petitioner pursuant to a now-expired set of amend. to the Foreign Intell. Surveill. Act of 1978, known as the Protect America Act of 2007, authorized the U.S. to direct commun. service providers to assist it in acquiring foreign intell. when those acquisitions targeted third persons are located outside the U.S. The petitioner challenged their legality before the Foreign Intell. Surveill. Court. When that court found the directives lawful, the petitioner brought this petition for review. The petition requires the court to weigh the nationís security interests against the Fourth Amend. privacy interests of U.S. persons. The court affirms the lower courtís determinations that the directives at issue are lawful.
